You confirm that you are the subscriber or customary user of this phone number and that you have authority to consent to receive text messages at this phone number. TXDRA will be sending promotional and marketing messages related to Texas Destination Resorts Alliance.

  1. Message Frequency/Source. Text message frequency may vary. TXDRA reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. TXDRA also reserves the right to change the short-code or phone number from which messages are sent and we will notify you if we do so.
  2. No Purchase Necessary. You understand that consent to receive text messages is not a condition of purchase.

  7. Scope of Opt-Out Requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from TXDRA through any other programs you have joined until you separately unsubscribe from those programs.

  9. No Class Actions. TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, YOU AND TXDRA AGREE THAT EACH MAY BRING CLAIMS ARISING OUT OF OR IN ANY WAY RELATED TO THE TEXT PROGRAM AND THESE TEXTING TERMS AND CONDITIONS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
  10. Forum Selection. Unless you and TXDRA agree otherwise, to the greatest extent permitted by law, the state and federal courts in [Austin, Texas] will have exclusive jurisdiction over any disputes. You and TXDRA consent to the jurisdiction of those courts and waive any objections as to personal jurisdiction or as to the laying of venue in such courts due to inconvenient forum or any other basis or any right to seek to transfer or change venue of any such action to another court.
